BY ADEMOLA FEBIAN ADEBOWALE ESQ., PURPOSE This article aims to explore ways by which a winner of a senatorial election in Nigeria is determined vis-à-vis Constitution of the Federal Republic of Nigeria 1999 (as amended), Electoral Act 2022 and INEC’s Regulations and Guidelines for the conduct of Elections 2022. KEYWORDS Electoral Act, Margin of lead principle, Election, Constitution, INEC’s Regulations and Guidelines for the conduct of Elections. INTRODUCTION Amidst the vibrant tapestry of democracy, one timeless element reigns supreme: the sacrosanct ritual of elections. Nowhere is this revered practice more evident than in the Federal Republic of Nigeria, where it finds its rightful place in the very heart of the Constitution. Truly, the Constitution stands as “the fons et origo,” an unwavering beacon of governance and the “grundnorm”—the bedrock upon which the entire legal framework takes form, meaning and origin from. The Nigerian Senate has just passed a new bill

The Nigerian senate has on Thursday, passed a bill which will enforce that an elected president and vice president of Nigeria be inaugurated at the premises of the National Assembly. This is a bill which will enforce that an elected president and vice president of Nigeria be inaugurated at the premises of the National Assembly has been passed.

The bill was sponsored by Ike Ekweremadu, the deputy senate president after several debates on the report of the senate committee on special duties. The House of Representatives must agree with the senate on the bill and the Executive will still have to assent it before it becomes a law.

If the bill is agreed to by the House of Representatives and assented to by the Executive, then the inauguration of president and vice president will be done within the confines of the parliament.

The practice will follow that of advanced democracies like Unites States of America and Britain
Inauguration of Nigeria presidents and vice presidents, before now, takes place at the Eagles Square in the Federal Capital Territory with the chief justice of the federation administering the oath of office.

My commentary: An average Nigerian would be wondering what good changing the place of inauguration would do. Will it in anyway prevent some leaders from being corrupt? Anyways, I'm guessing that they had a move logical rational for passing this bill than just for the fact that ‘it is practiced in more advanced countries'.
