IS THE MARGIN OF LEAD PRINCIPLE A LAWFUL MEANS OF DETERMINING WHO WON A SENATORIAL ELECTION IN NIGERIA?

Image
BY ADEMOLA FEBIAN ADEBOWALE ESQ., PURPOSE This article aims to explore ways by which a winner of a senatorial election in Nigeria is determined vis-à-vis Constitution of the Federal Republic of Nigeria 1999 (as amended), Electoral Act 2022 and INEC’s Regulations and Guidelines for the conduct of Elections 2022. KEYWORDS Electoral Act, Margin of lead principle, Election, Constitution, INEC’s Regulations and Guidelines for the conduct of Elections. INTRODUCTION Amidst the vibrant tapestry of democracy, one timeless element reigns supreme: the sacrosanct ritual of elections. Nowhere is this revered practice more evident than in the Federal Republic of Nigeria, where it finds its rightful place in the very heart of the Constitution. Truly, the Constitution stands as “the fons et origo,” an unwavering beacon of governance and the “grundnorm”—the bedrock upon which the entire legal framework takes form, meaning and origin from. In this great nation, the Constitution's hallowe

What is the idea behind Bride Price? Should it still be in practice?

Image
This article is formed from a collection of research articles on the subject matter being discussed. I must state clearly that this write up is not in anyway, aimed at reducing anyone (especially the female folk) because I know that many women (particularly women from those areas where this custom is still being practiced), after reading this, will react negatively. Rather it is a wake up call to women so that certain practices that derogate females in any form will be expunged. Having said the above, it’ll be appropriate to first give a succinct definition of what the term ‘bride price’ is : A bride price is a sum of money or quantity of goods given to a bride's family by that of the groom in some tribal societies . https://en.m.wikipedia.org/wiki/Bride_price   HISTORICAL TRACE  Bride price is an age long tradition that emanated from a voluntary act of appreciating a bride for remaining chaste till the day of her marriage which simply corroborates the biblical

President Buhari pays Biafra police pension

Image
Of all the things that have transpired between the Federal government of Nigeria, under the leadership of APC's Muhammadu Buhari v. those agitating to secede from Nigeria, known as ‘Biafrans', this act by the president has definitely gotten some people's attention. I guess we didn’t see this coming.  The Nigerian President has approved the payment of pension to police officers who served under the then Biafra police during the civil war. According to report, this was contained in a statement released on Wednesday, October 18 by the Pension Transitional Arrangement Directorate (PTAD). It was announced that about 162 of such retired police officers and 57 Next of Kin will be paid their benefits in the first phase which kicks off this month.  The Biafran police officers were granted presidential pardon in 2000, during the tenor of ex-president, Olusegun Obasanjo. The statement read: “The general public would recall that Nigeria witnessed an ugly civil war bet

Nigeria will play with the reserve team against Algeria

Image
The Assistant Coach of Super Eagles of Nigeria, Salisu Yusuf on Monday said that he would use more reserve players for the 2018 world cup qualifier against Algeria on Nov.11. Yusuf made the disclosure in an interview with the News Agency of Nigeria (NAN) while speaking on the team’s preparation for the Algeria match. He said that the match would enable the coaching crew to not only try the reserves but also select players for the final in Russia. “Some of the players have not been opportune to play, so this match will offer them such opportunity. We know there is nothing to be scared of because we already have the world cup ticket but our interest now is to have a blended team” Yusuf said. The coach pledged that the Super Eagles would not lose any of their matches, adding that they were ready to win the game against Algeria. The super Eagles currently lead Group B with 13 points and will slug it out with the Algerian side on Nov. 11, in Algiers. NAN reports that

Watch ex-president of Nigeria, Olusegun Obasanjo featuring in a comedy skit. Very funny indeed

Image
Former President of Nigeria, Chief Olusegun Obasonjo stars in comedy skit - Comedian, Samuel Ajibola, who played 'Dele' is the brain behind it. In the video - Baba (the ex-president) suggested that Dele (played by Samuel Ajibola) should run for President, as he would be supported financially for his political campaign in the comedy short film, only for Dele to wake up and realise that it was all a dream. On waking up, Dele was so upset with his roommate who woke him up from such a fantastic dream by pouring water on him while he was having a time of his life in dream world. Dele then warned his roommate that if "Baba" (that is Chief Obasanjo) does not make him president, his roommate must make him President. As Dele chases his roommate out of the house and into the compound, the comedy skit comes to an end. The skit is aimed at promoting the inclusion of young, vibrant and competent persons into vital decision making positions in Nigeria, especially politic

Lionel Messi leaving Barcelona to Mancity

Image
The Argentine and Barcelona superstar, Lionel Messi is really considering  the idea of signing for Manchester City in 2018. What most people thought and still think is impossible might just happen because Manchester City, under the management of Guardiola, have been trying to lure the football maestro to City.  Although, Messi might feel that he owes Barcelona for standing by him and leading him trough out his career, he also knows that he owes Guardiola even more because he was the one that introduced Messi to the spotlight. Anyways, let's see how it turns out. 'The Sun' says he confided in Argentina team-mates about his future during the international break. And Messi is torn over signing a new contract at the Nou Camp or beginning a new chapter in his career in Manchester. Negotiations with Barca have been ongoing for 18 months but the deal remains unsigned. City officials have met with Messi's representatives on several occasions — makin

Mikel maybe considering a return back to Chelsea

Image
Despite the fact that Mikel claims to be enjoying his time in China, it seems like his heart belongs somewhere else. Mikel, the talented Nigerian midfielder has hinted to the fact that he might return to Chelsea, and that returning to Chelsea is not an impossibility because he still has a good relationship with the club's management. Hearing this makes me wonder; will Chelsea fans appreciate his return to the club? Speaking shortly after helping Nigeria secure qualification to the World Cup in Russia, Mikel said he is open to the idea of returning to Chelsea in the future. “I didn’t have the chance to say goodbye on the pitch to the fans who stood by me for over 10 years, that itself is enough motivation for me to want to return “, Mikel said. “I’m very happy in China but then what I have learnt is that in football anything can happen. Chelsea is home to me due to my close relationship with the management of the team but I’m happy in China “. THIS WAS THE SAM

Cavani wants Neymar to win the balloon d'or

Image
Despite the previous feud between Edison Cavani and Neymar, the Uruguayan stated categorically that he would appreciate it if Neymar wins the forth coming ballon d'or. The pair have contributed to the success of their club and countries, with both Brazil and Uruguay qualifying for the 2018 World Cup in Russia. With the help of Neymar, PSG have been formidable this season, scoring at least 3 goals in every single match he has played. The only match Neymar didn’t play, PSG had a goalless draw against Montpellier.  “I spoke with him and told him what I thought, but they’re things that stay in the dressing room,” he told Ovacion. “I’m not going to tell you what we said to each other. The only thing I want is that all those who join the team do so with the intention of fighting for the team’s goals. Individual honours will come because the team does well, that means everyone is working well. “And if we have the best in the world, that’s great for me. I have said se

How Deadly is the Monkey pox disease? Check it out, don't be ignorant

Image
Viruses and epidemics have plagued us in the past. However, there is a ‘current king' in Nigeria  referred to as “Monkey pox”. Contrary to the general believe in Nigeria, this is not ‘a new curse by the gods' or something of that sort. It is not also a scam by Nigerian government officials to loot money by claiming they are trying to cure a disease they have fictitiously created. In case you are not aware, this is not a new disease and it wasn’t created by Nigerians. What is this Monkey pox? Monkeypox is an infectious disease caused by the monkeypox virus. The disease was first identified in laboratory monkeys, hence its name, but in its natural state it seems to infect rodents more often than primates. The disease originates from Central and West Africa. An outbreak that occurred in the United States in 2003 was traced to a pet store where imported Gambian pouched rats were sold. The first recorded human case of monkeypox was recorded in 1970 in the Democra

Are Foreign coaches the answer to Nigeria's World Cup problem?

Image
The Nigerian National team has just qualified for the 2018 World Cup in Russia and this has raised the hopes of many Nigerians once again, with the name “Gernot Rohr” being on every Nigerian's lips, as the one that has liberated the Nigerian National team. Gernot Rohr, a German is the current Nigeria team coach and he has just taken Nigeria to the World cup without loosing a single match during the qualification stage.  Nigeria are three time African Champions, with their recent title in 2013, defeating Burkina Faso in the final. During April 1994, the Super Eagles ranked 5th in the FIFA World Rankings, the highest FIFA ranking ever achieved by an African football team. They have qualified for five of the last six FIFA World Cups, missing only the 2006 FIFA World Cup hosted in Germany and reached the round of 16 three(3) times. Their first World Cup appearance was the USA'94 World Cup hosted in the United States. Having known a little about the Nigeria tea

Harzard wants Champions league glory

Image
Eden Harzard of Chelsea Football Club has his eyes on the champions league trophy as Chelsea kicks off their champions league campaign today. Hazard sees himself as a big player and as such, has the aspiration of a big player. Can Chelsea lift the champions league this season? Despite all odds, Chelsea can actually become champions of Europe because as they've shown in recent times, they aren't afraid of any team and no matter the condition of the team, Chelsea can scale through, probably because they have the mindset of champions. Chelsea playmaker Eden Hazard says he is keen to win the Champions League title as his club begins its European campaign with a group stage match against Azerbaijani side Qarabag today (Tuesday 12th Sept., 2017). Hazard joined Chelsea shortly after they won their first Champions League title in 2012, but the Premier League champions have not won the competition since. The club came close in the 2013-14 season, but lost to Atletico

Finally, Neymar Jr. reveals why he left Barca for PSG

Image
Despite many attempts to keep the player at Barca, Neymar ended up breaking the hearts of Barcelona fans by eventually leaving the club for the French giants, Paris Saint German (PSG).  In as much as he was having a lovely time at Barca, Neymar still insisted on leaving the club and people have been wondering why. Some say it’s because of the money; that such an amount offered to him is irresistible and attractive. Some say it’s because of issues he was having at the club concerning tax, whereas some people believe that it’s because Neymar wants to leave the shadows of Lionel Messi and go on to be the Best Player in the World.  Finally, the reason why Neymar left Barca has been revealed:  NEYMAR insists he swapped Barcelona for Paris to grab Champions League glory. Paris Saint-Germain smashed the world transfer record when they captured the Brazil star from the Nou Camp for £198million last month. An eye-watering £500,000-a-week is also being paid into his ban

DEAF AND BLIND AFRICAN LADY GRADUATES FROM HARVARD LAW

Image
This story put the whole world at a stand still as a blind and deaf African lady, Haben Girma becomes a graduate from the best law school in the world (Harvard). On hearing this, I wondered how someone who cannot see and cannot hear could go to the university in the first place, talk less of graduate. This is truly remarkable! Many people believe that anyone who has a disability has no reason to live but this woman has proven otherwise. After graduating, she didn’t stop there but has been putting a lot of effort to make sure that the rights of those that are blind and/or deaf are preserved and respected.  Haben Girma, Harvard Law School's first deaf-blind graduate, is fighting for accessible education for other deaf-blind people worldwide, according to BBC News.  The Eritrean-American was born in California after her mother escaped Eritrea in the early 1980s. Today, Girma is a successful attorney who advocates for civil rights of people with disabilities, reported

WORLD'S BEST PLAYER : Neymar will become the best player in the world

Image
In football, one of the greatest talents that has caught my attention is Neymar Jr. He’s so good that one would wonder why he shouldn’t be world best. Cristiano Ronaldo and Lionel Messi have dominated football in recent years so much that their peers have lost hope contending to be World best. People now make statements like “they are from another planet” or “they are gods of soccer” but they forgot to mention one person….and that’s Neymar. Now the issue is ; what criteria is used to measure who deserves to be the best player in the world ? Is it by scoring goals ?  Is it by winning trophies ? or is it by dribbling ?  The answer to this question is ;  there is no strict way, enshrined in any law or statute on what someone needs to do to become the best player in the world. However, when we see a player’s performance, we can tell where he is heading. Having said this, I’ve watched Neymar right from when he was at Santos, till he went to Barcelona and now he’s curre

UNIVERSITY OF PORT HARCOURT PULLS OUT OF A.S.U.U.

Image
One thing that has consistently made the headlines in Nigeria is strike. Either university lecturers are going on strike because they haven’t been paid salaries or student aiding strike because of poor educational environment/ increment of school fees, or one union or the other is threatening to go on strike. Strike is a mechanism used by Labour Unions to compel their employers heed to their demands after all other mechanisms have been deployed.  The issue of strike in Nigerian Universities has been so prevalent that students now take it as a norm. Some Nigerians even prefer studying abroad because in Nigeria, a student can spend more than his required time for a particular course of study due to consistent strikes. That is, a student studying a course meant to be studied for 5yrs might spend 8-10 yrs for that course as a result of strikes, while their counterparts studying abroad finish school and start putting their education to good use. If you are in the ‘strike s

BIG BROTHER NIGERIA - "WE ARE A PART OF EACH OTHER'S SUCCESS STORIES" Bisola tells other female contestants

Big brother ex-housemate Abisola Aiyeola, popular known as Bisola has made the headlines again by sending a shout out to other ex-housemates(females only) on Instagram. This beautiful lady is known for her love and support for women, seeking to promote the confidence and relevance of women worldwide. What a way of showing it. She revealed that people expected them to be enemies after the Big brother contest due to the misunderstandings they had during their stay at the big brother house, but rather than being enemies, they are closer than ever (according to her) For those of you who aren’t aware, she had been auditioning for Big Brother for about 9 years before she got accepted in 2017. On one of the occasions, Bisola went for an audition with her 9-day-old baby and had her sister look after her in the car. It’s been more than four months since popular reality show Big Brother Naija came to an end, it’s nice to see that the housemates are still friends. Bi

The Most Wanted Person In Nigeria: Where is IFEANYI DIKE ?

Image
There are certain things we've witnessed in Nigeria that has embarrased us but this...this is a National disgrace. Witnessing this happen in Nigeria has got me wondering how secure we are in this country with this level of incompetence from the Nigerian Police. For those of you who don’t know, a 200 level student identified as Ifeanyi Dike confessed to rapping an 8yr old girl and cutting off her body parts, including her vagina, to use for money rituals. The part that has got me ragging is that this young man was caught by vigilantes and then he was handed over to the NIGERIAN POLICE for prosecution. On arriving at the police station, something “funny” happened. He escaped ! Can you imagine that ? Like who would have thought that we had a “Michael Scofield” in Nigeria ? Is this the ‘Prison Break’ movie ? If I was in charge, I would have sacked/punished everyone who was on duty at that time and who’s duty post was incidental to that escape. This is preposterous ! How can

Latest News on Jamb Cut off mark

Image
The news of the return of post-Unified Tertiary Matriculation Examination (post-UTME) was a great shock to university admission seekers and their parents. More shocking, however, is the cut-off mark that was reduced to 120 from the 180 marks that it used to be for universities. The Joint Admissions and Matriculation Board (JAMB) declared last week Tuesday, August 22, 2017 that 120 would be the minimum marks required to make a candidate eligible for admission into any university in Nigeria. JAMB also announced that the minimum cut-off marks for admission into polytechnics and colleges of education shall be 100 marks, while innovative enterprise institutions had their cut-off marks fixed for 110 marks. These cut-off marks were disclosed by the JAMB Registrar, Professor Is-haq Oloyede, at the end of a policy meeting with authorities of Nigerian tertiary institutions. Speaking further, Professor Oloyede said 569, 395 out of the 1.7 million candidates who wrote this year’s UTME scor

WHY DO WE GET MARRIED ?

Image
This question might seem simple but it’s not. The reason why I say so is that when you look at it critically, coupled with the marriages we witness these days, it makes me wonder why we ‘tie the knot’ in the first place. On several occasions when I’ve had discussions with people, I’ve asked them this question and got some interesting answers. TO REPRODUCE: If I set this as an examination question, I’m very sure that this is what most people will say, especially those who study science. Most people believe that the essence of getting married is to give birth to babies. Their reason needs to explanation really but I ask, can’t people give birth without getting married ? Are you telling me that the reason why I decide to spend the rest of my life with a woman is so that we can be baby producers ? Now that’s interesting…You will agree that there’s more to marriage than making babies because you can have them without getting married anyway. As a matter of fact, with modern scientific
