IS THE MARGIN OF LEAD PRINCIPLE A LAWFUL MEANS OF DETERMINING WHO WON A SENATORIAL ELECTION IN NIGERIA?

Image
BY ADEMOLA FEBIAN ADEBOWALE ESQ., PURPOSE This article aims to explore ways by which a winner of a senatorial election in Nigeria is determined vis-à-vis Constitution of the Federal Republic of Nigeria 1999 (as amended), Electoral Act 2022 and INEC’s Regulations and Guidelines for the conduct of Elections 2022. KEYWORDS Electoral Act, Margin of lead principle, Election, Constitution, INEC’s Regulations and Guidelines for the conduct of Elections. INTRODUCTION Amidst the vibrant tapestry of democracy, one timeless element reigns supreme: the sacrosanct ritual of elections. Nowhere is this revered practice more evident than in the Federal Republic of Nigeria, where it finds its rightful place in the very heart of the Constitution. Truly, the Constitution stands as “the fons et origo,” an unwavering beacon of governance and the “grundnorm”—the bedrock upon which the entire legal framework takes form, meaning and origin from. In this great nation, the Constitution's hallowe

WHY DO WE GET MARRIED ?

Image
This question might seem simple but it’s not. The reason why I say so is that when you look at it critically, coupled with the marriages we witness these days, it makes me wonder why we ‘tie the knot’ in the first place. On several occasions when I’ve had discussions with people, I’ve asked them this question and got some interesting answers. TO REPRODUCE: If I set this as an examination question, I’m very sure that this is what most people will say, especially those who study science. Most people believe that the essence of getting married is to give birth to babies. Their reason needs to explanation really but I ask, can’t people give birth without getting married ? Are you telling me that the reason why I decide to spend the rest of my life with a woman is so that we can be baby producers ? Now that’s interesting…You will agree that there’s more to marriage than making babies because you can have them without getting married anyway. As a matter of fact, with modern scientific

LET LOVE LIVE

Oh love ! It’s such a special word but we abuse it. We say it all the time but we have no idea what we mean. We claim to feel it whereas we don’t have a clue what it feels like. See ee ! Love is sweet oh ! Chey ! Love… I’m not a certified expert on love but I believe that I know what love feels like. Before I talk further, I think it’ll b appropriate to define what love is: Love is a profound and intense feeling of affection, attraction and care towards someone or something. I’m aware that many books written by people provide that there are different types of love. Let’s not get it twisted I’m talking about romantic love…Yeah, that kind of love that exists btw couples, a guy and a girl. Initially, you get attracted to someone for their physical appearance, however, if cupid shoots you his arrow you’ll be like a fool. (Lol) You’ll think I’m joking but I’m serious. When your in love with someone, seeing the person tickles you inside, hearing his/her voice sensates you, getting cl

WE ARE ONE

If u ask an average Nigerian where he or she is from, they’ll tell you that they are Yoruba or hausa whereas many Igbos will tell that they are Biafrans. Actually, the answer a Nigerian gives depends on the place or situation he finds himself. For example ; a Nigerian will regard himself as a ‘human being’ if he finds himself in a situation where humans are at war with maybe aliens or robots (from science fiction movies) . In another form, a Nigerian will perceive himself as an ‘African’ in a situation where the different continents are in dispute or are competing for something, like the Confederation Cup. At a different level, a Nigerian can call himself a ‘Nigerian’ where they are sharing money or other privileges to Nigerians and he’ll want to be a beneficiary. Most Nigerians are not proud to be Nigerians except when Nigeria is globally praised for achieving a great feat. Then when u come to Nigeria, many of us don’t see ourselves as one Nigeria but rather we see ourselves as

YOU ARE SPECIAL

I went to write an exam some months back and when I saw other people who wanted to write that same exam with me, I became scared. I started asking myself; “how can I qualify when we have over 300 people here to write an exam that only about 150 people will be selected?” I never thought for one second that I could make it. I felt like all hope was lost because there was no way I could outsmart others to be one of the selected persons. After a while, this thought came to my mind; “how are others feeling right now? Well, I’m sure that they are confident or perhaps they are scared as I am”. The truth is that everyone is scared but some other people know to hide their fears and look tough on the outside. If you don’t know this, you’ll feel that they are all geniuses or perfect robots but trust me, they are not. They read just as you read, they bleed just as you bleed, they can fail as well but do not believe that you can fail at all. Everyone is as special as he/she perceives h

MY LOVE EXPERIENCE 2 'Do you believe in fate?'

When I gained admission into the university, guess what? I saw someone from my past. Guess who it was? School was about to resume session for the first semester so I went to school almost everyday to make enquiries about the fees that I’m meant to pay and also I wanted to be familiar with the environment so that I’ll know my way around the school. Rivers State University is a state owned university in Nigeria and I gained admission there to study law. For those of you who may not understand or know where Nigeria is located ; Nigeria is a country in Africa. It is made up of blacks who were colonized by the British, educated and are working towards becoming a better country. Nigeria is made up of states (36 states + Abuja, which is the capital) and Rivers state is one of them. I am from Rivers State actually and that’s where my school is located. Now back to my experience… As I was about to leave the school premises through the gate behind the school, I caught a glimpse of an Ang

MINE IS LIONS, WHAT'S YOURS?

Most times when i run out of what to say during a conversation with someone, i ask the person i'm chatting with this question: "if you were to be an animal, which would it be?"Though this hasn't been proven by psychologists but i believe that the animal that the person honestly selects is a reflection of how that person percieves himself. How? okay, the rational behind my answer is that, for example if a person selects a cat, before the person gives his/her reason for the answer what will come to my mind is that the person percieves himself as probably being sexy, or loyal to his family because a cat obviously has a sexy way of walking (cat walk) and it is common knowledge that no matter where a cat goes, it somehow finds its way back home. As for me, i'ld love to be a lion. The lion is not the biggest animal in the jungle, it's not even the biggest cat in the jungle. Lions are the laziest of the big cats because they spend 16 - 20 hours of the day sleepi

MY LOVE EXPERIENCE

Uhhm... I'm actually shy talking about this but uhh...okay...here we go. I love movies a lot and i'm not just talking about a particular kind like action or romantic, etc. I love all types of movies as long as it's interesting. However, in as much as i watch Korean, Mexican, Chineese, Nigerian, American movies, i have a special interest in American movies. Maybe it's because of the way that they always seem to appreciate their military forces, and their soldiers that diligently served their nation OR maybe it's because no matter the direction the movies are heading, it most times has the part where a cute guy falls in love with a beautiful girl. Alright alright i know i said i'll be talking about my love stories. Okay then...My love experience , i mist say hasn't been that dramatic.  In fact i don't think it's been dramatic at all. Growing up as a normal kid, i've had feelings for girls especially the ones in my class and tru

Reasons why we feel divided in Nigeria

*Laughs* i know this is not a funny issue but rather a serious one, especially due to the fact that i'm claiming to love Nigeria with my heart and want to see it grow and develop. Let me make some things clear first: i am a realist. However, i can be optimistic too, maybe it's due to the fact that i am a christian and christians live by faith and not by sight...I'm not sure but that's how it is. Now that i've cleared that, it is crystal clear that Nigeria has problems. Actually, which country doesn't have problems? I believe however that knowing your problems is the first medicine that can solve them, or at least help to solve them. Growing up as a kid, i learnt in school that the source of the problems in Nigeria originates from the invasion by the British and other foreigners i.e. during the colorial period. Having grown up, i started thinking and i came up with this - the problem with Nigeria is Nigerians. No matter how we try so har
